Cardi B Appears In Court As $5m ‘Raunchy’ Cover Art Trial Begins

This week, Cardi B is back in court as her attorneys try to show that she is not to blame for the shame a man alleges he experienced as a result of listening to one of her mixtapes.

Body art enthusiast and model Kevin Brophy, Jr., the plaintiff in this lawsuit, alleges that a picture of his back tattoo was taken for the 2016 cover of Gangsta Bitch Music Vol. 1. In the disputed piece of art, Cardi is seated in the back of a limousine while a male model is kneeling in front of her and appears to be engaging in oral sex.

In their opening arguments, the attorneys for both sides, according to Rolling Stone, agreed on how a picture resembling Brophy’s tattoo ended up on the cover. The cover’s graphic designer chose to swap out the model’s tattoos with a different design after the initial photo shoot.

He chose to incorporate a portion of an online photograph of a tiger and a serpent that turned out to be a portrait of Brophy. In his testimony, he stated that he regards to design as a fundamental aspect of his identity.

He recalled, “I felt like my Michelangelo was physically pulled off the wall, robbed, and put wherever these folks wanted to put it. “It appears as though I’m having oral sex with someone who is neither my wife nor my partner, and this is an image that I have never, ever given my approval for.

“This goes against all that I stand for as a father of two, a loving spouse, and a man of faith, and I would never ever sign off on something like this,” he concluded.

Peter J. Anderson, Cardi’s lawyer, made a number of reasons that he believes invalidate Brophy’s lawsuit. Specifically, the fact that the Black man with visible hair on the Gangsta Bitch Music Vol. 1 cover is a Black man. Brophy has a beard and is of Caucasian descent.

Another tattoo that can be seen on the plaintiff’s neck is also absent on the model in the picture. Anderson asserted that it is doubtful that anyone would have seen the picture and thought Brophy was the man in it.
According to Anderson, “They have not named any individual, including a member of the public or a friend, who made that statement.”

In response to Brophy’s assertion that he has received inquiries regarding the artwork, the lawyer continued, “That’s a self-inflicted wound. When no one else recognized him as the person in the image, he caused that by identifying himself.
The tattoo that appeared on the mixtape cover was altered by the graphic artist, thus creating a new image, Anderson continued to tell the jury. The work would still belong to the tattoo artist even if the original tattoo had not been altered.

However, Brophy’s legal counsel claims that the “Hot Shit” rapper ought to have avoided getting the tattoo in the first place.

According to attorney A. Barry Cappello, “This was his likeness.” It’s personal property and a private citizen’s identity, not that of another celebrity. This individual is private. According to the laws of the land, you cannot take something unless you ask for it or pay for it. It is forbidden to use someone else’s image offensively or to present it in a false light.

Cardi listened quietly on Tuesday (October 18) while her attorneys presented their case, despite the fact that she is scheduled to testify throughout the four-day trial, according to Rolling Stone. U.S. District Judge Cormac J. Carney informed the jury that the trial would continue this week.

Cardi is still involved in a legal dispute with Tasha K. in the meantime. Despite receiving a $3.8 million judgment in her defamation case against the vlogger, she and her legal team returned to court last week to ask the judge to step in and help her collect her money.

Cardi B’s demand for a Supersedeas Bond, which compels the internet celebrity to produce collateral to cover a payment of $3,863,753.47 through a bond business, was reportedly approved by Judge William M. Ray II, according to AllHipHop.

After Tasha (actual name Latasha Kebe) asked the courts to halt the “Up” rapper’s effort to garnish her earnings, the decision was made.
